As modern society grows older(I hate to use the word matures as it would seem we are getting dumber and not wiser as we age) males are no longer needed as the absolute upper echelon/leader/head of any part of society, while society still favors males its much less so than it was decades or even centuries ago. Now unlike the old problem of being white/male to be seen as “perfect” we have in this age various new issues focused around fairness which are rarely fair or equal, are things better or worse, yes they are better but frankly as I see it we have traded absolute “male rule” for whimsical trend rule meaning whatever group can lead a discussion or create a superfluous fix to an assumed problem can somehow can the lead and make discriminatory and bigoted rules and laws because they are part of the oh so cherished and pampered in crowed.

We as a modern society need to get past color,race,creed and ourselves as groups and labels and get to a place we can talk about we and us as equal individuals under the order our laws and rules are suppose to bring us…. we are still concerned with what divides us even if just in appearance then what brings us together….and that makes us petty hairless apes, in my book….

Torrents, sharing and revenue streams oh my!!

With todays one off train of thought/ energized mental mussing I try and hammer out why making money off sharing others people stuff is wrong….. some of the time.

If a  sites main, 2nd or even 3rd goal/service is torrents non contracted/approved file sharing then it’s wrong to make money off it, why is it wrong you ask, because its directly making a profit from someone’s else’s blood and tears, corporate masters who bath in said blood and tears oblivious to all be damned this is not so much about them…or the DMCA which keeps them in sinew and bile..

An example of a site that is indirect, how about afterdawn.com I don’t see a A.D. supporting torrents directly as in hosting trackers and what not, what I see it indirectly supporting it via information and news, and indirect support via software loopholes. There is a difference in direct and indirect, cracks might use some IP directly in tiny bits and pieces so much so that’s its “indirect”.

More examples there of below.

Sharing copy circumvention that has in whole(as in all the copy protection that’s altered to patch software, not all the information to run the software just a few vital pieces) or part is IMO “indirect” and even if it was direct its rather easy to build a patch file that just applies the new information thus its kinda moot, even more so if you claim that it cannot be freely traded just cause you own it, as I have alluded to or said owning it means you only have profit rights.

Sharing the whole software would be “direct”. There’s no getting around that, this is black and white because around 50%(well 30-50% depending on who you believe) of the most frequently traded stuff is NEW, while anything older than 5 years makes up the rest of it.

Shearing a freeware program to rip or mount is “indirect”. This should be obvious, and as long as we have personal freedom there should be nothing wrong about it.

Shearing the whole media/medium is “direct”. Like software-kun above there’s no real wiggle room, but there again I am talking about profit made off it.

Sharing un copy righted/public domain works, this should be obvious to the theme of this musing its indirect. Furthermore I want you to think for a moment over something if we had no IP/CP laws would it be chaos or would live in a media industry based on who can provide better cheaper entertainment/products we would certainly not have much conglomeration of power and money we would have many more small business who thrive on working day to day to finish a project that brings in millions. We would have fewer media millionaires but have many more middle class workers who just happen to be artists.

But in our current less utopian world profit is something that only the IP/CP owners should have exclusivity to but distribution itself should always be in the whims of the public. Because they support media regardless of price and quality.

This is something neither side rarely bothers with because it tends to be an all or nothing argument, I don’t see it in such contrast. We could easily have both ,think legal sharing host services where donations taken directly through them for service cost the one who starts up and pays for some of the hosting cost runs the site normally but the donations are funneled directly to cost when costs are met there is an allowed 25% overflow and costs are caped and will not take more donations until it drops under 90% from 125%, the service takes 3-5% for operating fees and of that as much as 60% is funneled into organized media this way the people get their free stuff and the monolithic god of old gets pacified with some tributes that can get back to the artists if they are tenuous enough)  we could have a system that would allow for free shearing either by the system I mentioned or via a type of nonprofit where both gov and corp can go over excess revenue(25-50% over maintenance cost) but it’s an all or nothing illogical world of dog eat dog, why would the corporate empire share when it can walk upon the masses and still make money.

My point, even anarchy requires order and limits, without it it’s just another dog eat dog world no better than the last. Meet the new boos same as the old boss,ect,ect.

Why do all good thoughts come to me while on the porcelain throne….

Oh well on to my musing…..

5 barriers to enjoying anime

Anime or even animation in general can be an acquired taste, there are certain barriers that keep most people away from it and I will try to describe them as best as I can and why they don’t affect me so much.

—Language—

Primarily language is the first and largest barrier, most people are not use to nor care to read while watching a film. Culture also can be a issue but I think it’s not as big of one as dubbing which is the next barrier, but for me language is not an issue I do like good subbing that tries to translate what is said without watering it down too much, information tends to be slowly digested in my brain anyway so English or Japanese’s or gibberish it’s all discombobulated in my head.

—Localization—

Localization tends to reduce the dialog and script to bear essence then they ad lib it to death to match mouth movements, this can make already watered down or Americanized scripts painfully bad then of course add bad or lack luster voice work and you have a good train wreck in the making. Unlike all the other barriers localization is grating to me few shows take the time to do it right and thus I would simply rather not be forced to deal with it at all.

—Fantastical Fiction—

The next barrier could well be placed above localization and that’s the high flatulent fiction that is used from fantasy to sci fi to anything in between you have strange and/or abstract worlds and characters which can easily turn many off, speaking of characters the next barrier is well characters or more precisely minors, minors are the main stay or fodder of anime and the next barrier. I take fiction like language it all gets  discombobulated in my head and I take them as they are most of the time, sometimes tho a show will have the wrong mix of story/character and I am just not enthralled by it.

—“Minor Character’s” —

Minors are the main character type combine  this with annoying personalities and odd environments and fiction you have a quickening of disdain and dismissal of it as being childish or silly.  But for me characters are ageless and loli/pedo jokes aside characters like fiction get  lost in my head and I take them for whatever they are rather than try and nitpick them to death though sometimes it cannot be avoided….

—Culture—

Culture is the last barrier a lot of myths and generic settings use a lot of Asian cultures and myths sublimely or not mixed into with more modern/western themes. This can be confusing to some or just a turn off to others. I find culture to be the random things we do as we humans gather together to eke out an existence as a community so I either can dismiss it there as or enjoy the nuances there of, either way it just adds more flavor and/or depth .

—Disbelief of enjoyment—

Anime can be enjoyed if you are equipped with a good sense of humor an active imagination and the ability to dismiss things for the sake of enjoying what you watch, it’s to be said suspension of disbelief is a double edge sword if you can like anything then the worst kind of crap will be shoveled out by the industry if most people can like anything that is. If you have a moderate suspension of disbelief you can cheery pick what you like while avoiding the really bad stuff and in a sense make the industry better buy not buying into to anything they poo out…

But in the end we all have limits on what we enjoy and what kinds of entertainment we are more tolerant too. For me animation and games I have a much lower tolerance for bad writing and dialog than film or TV.

Zippy plus CRC (copy right circumvention) Well I have come to realize/find out (ah ignorance how blissful you are) that personal use is pretty much done since anything related to copy circumvention is illegal under the letter of the law. Despite that I would still say that under its combined sprit (CP, fair use and even the DMCA) it’s not so much about circumvention but personal use that its fair to circumvent protections for personal use. But even if it’s illegal now(for a few years actually) it’s basically un-enforced…and that’s makes me wonder if its un-enforced why is it even illegal when the real crime part of it is still a crime IE the distribution of the content.

Even if I believe that nonprofit based distribution should be legal to offset infinite CP and the power of the CP conglomerates one thing needs to be dealt with at a time. Personal use needs defined more than profit in copy right moving forward, personal use is where the line needs to be drawn in the sand and etched in stone. Personal use should be defined as anything done in the presence of the private end user in their limited to public private life.

Fair use is pretty much personal use but fair use pertains more in my laymen’s sense of things. Fair use is mostly about parody and how the conmen consumer can distribute CP/TM works via news or commentary which can allow for clips of various types (mix clips of a video with a song or a video of real non CP/TM people with CP/TM works in or around them). Limited as in as few people in public as possible mostly for portable media players and what not and not broadcasting/public performance or distribution online or off.

The minute a piece of media gets into the hands of the end user all rights of the CP owner end but distribution and invasive connections to the games online servers. This will allow for user made patches, fixes and end user protection against corporate over sight (IE all the stuff they miss focusing on limited anti consumer schemes) distribution will still remain the privy of CP owners lest until the system realize CP as it was meant to be is dead and fair use and public domain watch words for criminals. I still think the best thing moving forward is to give a corporate infinite copy right that specifies profit not distribution, allows for nonprofit non revenue gaining, meaning that costs of running the service with low paid or no paid labor at all levels of the organization compared against notional averages, if you are a private individual you can spend your money for distribution as long as you are not making a profit off it. This will allow nonprofit organizations to spread anything they deem educational or beneficial to society not to mention be able to run nonprofit based donational drives that can be used to buy up CP for the purpose of making it public domain. It will help corporate focus on real crime IE illicit profit and questionable organizations and get them out of the pants of the conmen end user and consumer.

It comes down to one sentence “If it’s not making profit it should be ignored.”

The way copy right works to stop the free trade of thought and ideas is staggering and anti productive. One could say they do not want any new content made they merely wish to create a stagnate environment to milk from. The main trouble with the scenario is that free distribution of even media that has been forgotten by their rights holders, the other issue is in the age of easily traded data one cannot block the trade of thought and yes I am equating media with thought.

With the advent of the 100 year copy right tis clear the copy right system is broken and with the way they harass consumers with the “commandment” to protect their copy right its clear its antiquated.

So how do we foster the health of an industry while protecting thought? Well first you remove the term distribution from copy right altogether. The main reason for it is its simply unenforceable, the second reason for that is due to the nature of the modern world and the properties that come from a healthy and imaginative populace this will easily displace any harm done by giving the industry of rights holders more choices to chose and pick from, another reason for it is out of print works that’s the rights holder refuse to do anything with this will only get worse over time as more and more properties are bought up and archived to never see the light of day that combined with ridiculously long term copy right makes for a even worse situation .

But enough of that back to my question “how do you foster a healthy media industry without government fascist media police”? Well you change the nature of copy right from a distribution based system to a profit based one. Distribution is replaced with “profit”, illicit profit crimes such as selling media without a license becomes a crime equitable to selling drugs, and this is the same for sites that “sell” services through normal revenue means or through advertisements, I would like nonprofit and or donation based fan driven services to be highly protected from corporate trolling.

By focusing on profit and business you allow for permanent copy rights that can be sold and traded by their conglomerates like any other contractual sale, selling off the rights gives the new owner full rights over the profits derived from the property and allows for better vaulting of properties as when the fan base can build itself back up via open source means the rights owners can use much of it to release new media of that property and sell it to an interested market instead of ignoring it until things are prefect and suing people that are trying to enjoy the media and show others it at the same time.

There really is no down side to focusing on profit and for profit(business), letting personal/privet and educational use the media as they see fit as long as they do not sell it.

I can see chilling effects as used sales could be “taxed” since it’s a profit based setup and a profit based copy right system doses no different in resell and sell it would not be difficult to place a 1-5% charge for resell rights or simply make it a exemption as it is now. Another would open ‘nonprofit’ parody more while tightening up ‘for profit’ parody how this will play out I do not know but I am sure the industry will test a lot of things under a new system.
Shareware, open source and such will not change much if at all because of the profit nature of business and selling, any distribution outside it will happen regardless of it being protected or not.

A rant to the side…..

While thinking about this I am reminded of music licenses for film and TV, why must one pay so much up front to advertise for the music that’s only a part of the experience? Why not base the contract on profit via standardized rates 5% the first year or so,1-2 after that in that way everyone makes a continued profit off it without any huge hiccups that are seen in Anime licenses where a the song owners can rape any project for domestic release. Again looking at future profits off it is far more effective and allows the domesticator to push song sales via normal merchandising channels IE sell the CDs through their store or retail outlets or as DLC online, through profits will mostly go to the song owner.

Speaking of songs and other original content creators get milked on their should be a basic rule that content creators get 10% of all profits from the content they make for life, this will hopefully lessen the rapeage they undergo as big content farms them for all their worth and gives them so little.

Alright I updated it with a new mod for smaller damage boost, so there is 3 kinds in this 1 ups damage 6 or 8 points,middle ups damage 8-10 points the last one ups damage 20ish points but halves the clip and makes the weapon costly to repair and buy.

ack! there seems to be a probly with the mod,fomm ate what I was doing that or I cut and pasted the wrong thing, damn kitty bwains!! I’ll fix it in a bit..and add a low engery mod to it that offers a slight boost in damage.

And today we start with “Disc/Data to Hard drive”.

If you have been hiding under a non technological rock you might be surprise to know you can buy and download (IE DLC/download content) some last generation games to your console this is nothing too exciting in itself but will lead to some real inserting developments in “current” gaming.

Not discounting the WIIs virtual console but reselling us old games we might own and not developing a add on device for current hardware is a wii bit annoying even if they could do both and charge us out the ass for the “experience” like most of the industry dose for current games of grand anal carnage(IE 50$ flawed and crappy games) but it seems they are focused on bigger shinier probes what with Securoms march on consumer rights but PC DRM is for another day me thinks.

With the WII leading the way in reviving the dead Sony and MS have followed suit and I do discount everything on live but the Live focused games on the 360 its clear MS made a mistake on locking the hard drive and then getting out the anal probes to rob of us money when they offer a hard drive for 2 or 3 times the cost of a normal drive…

But I am regressing and before I start whining about RROD I shall kill the demonic trud that has formed from something crawling up my ass and dieing and move on.

Moving on to DRM which is the corner stone to how they sell products to the us the fuzzy masses who buy into half the poo they sling and some of us just point and laugh at the poo like the sad lil retards we are..but enough about me already….

DRM is part of the authentication of the selling process thus part of the sale and it has to change, change to a coherent non “rent” focused system we the consumers need 2 receipts one for the consumer to be stored any way the user wishes to store it(Defaulting to the consoles HD in a easily copyable file format, USB card,Mem card,ect,ect) and one on the account you cannot move to sell digi media as a normal and trusted practice until you protect the consumers investment into it, this does not mean you get rid of renting it just means it’s another layer of protection and authentication for both parties in a digital transaction.

Allowing the DRM to do this with a authentication check when you download it and random authentication checks per week/month will be all the protection industry needs as unlike on the PC you can permanently disable the online access to the unit/account.

Now with a per system authentication system things can become crazy for households that own more than one unit so you’re going to need a account system that can have multiple consoles per house hold verify it by IP range and either charge a flat fee per unit or a 1/8th -1/4th rate for each additional unit thus allowing people to spend more money on games, units and accessories not to mention countless micro transactions.

Buddy system 2.0

Also a buddy system to rent shared time for a small fee would be good so you can go over to your buddy’s house for the weekend and can’t take your unit and what to share the cool stuff on it, by initiating it on your end and sending a invite to your friends unit you can turn on a share setup allow the other unit full access to whatever your unit has even allow you to copy off games onto a portable device pug it into your buds unit and through authentication will work on his unit, to prolong the rent time your buddy or you can pay for more time to rent “shared” status.

Take the above into consideration and allow people to transfer stuff to and from their consoles for a small fee if under a buck money can be made here if you apply the right mindset to the process.

Shared distribution.

Now that you have a proper receipt system with authentication that links to not only the system but the account it’s tied to you cannot only sell new whole games from your digital store but allow retail games to fully “download to disc” allowing for quicker loading and other features. Again this does not mean you cannot rent items, in fact renting a whole game for 10$ to start and 5$ a week after the first week might replace clumsy retail altogether but you have to understand the process it’s not going to be perfect even now people can buy a unit leave it offline and play any illicit copy they want without opening the console up (yes that’s you MR high attach rate 360) but what you want to do is remove those who break the rules online while giving those who play in the rules more features and value at less cost to them.

Now just because you give consumers the right to re download their purchases does not mean it has to be free a small fee of a buck or less would help keep the gears of the network greased.

Final thoughts

People are willing to pay for extra worth while features why else is live gold subscription so damn hot, we need more features at better costs what I would like to see is consoles not having locked hardware like the 360, that you have your units attached to your account and allowed a easy system to trade/give and “share” the stuff you have bought or rented but for a fee of credits, the credit system is quite a interesting setup you gain them (specials,gimmicks, new game purchases,subscription plans,ect,ect)you buy them you should be able to share them, with maybe a 10% fee as you need to lessen “free” credits as much as you can thus having smalls fees on this and that balances out the whole system.

With a proper credit system a free account can buy demos,downloads and other items as they go with a subscription you get credits and a lot of free content, of coarse this is mostly the PSN model but if you mix in alil LIVE and have a 2 or 3 tier system but lets not hack up the speed for multiple tier levels for them to nickle and dime us to death with.

A solid network thats free to all console owners with a small fee of 2-5$ for unit/account transfers blocked units will require a Ccard and home address thats not the same address as the old user, that or a 50$ fee reconnect perhaps a mix to balance things out.

Unit/account linking is not inherently bad if one has a house hold of multiple units they could be put on with 1 flat fee and share most content between units , a constant flow of some profit is better than irregular profit and that is the mindset the industry needs to comprehend not the “as much as you can get as fast as you can get it” quagmire.

Cheating at control, a rant.

Also since games are rushed in development and console makers are all the more wary of cheat systems we need more and varied cheats to re balance the supposedly finished product.Cheats offer not only a crutch to finish a mediocre game but add FUN to an otherwise stale product.

Control is currently the biggest demonic turd for me no matter how much I try to shat it out it lingers and smells….could be BO but I can’t tell anymore…but really not every gamer plays the same and full control mapping is something basic all devs need to understand it can turn a clunky horrid game (insert game here or  Manhunt) into a fun stealth killing spree (A port that strangely offers more button mapping like Manhunt on the PC with extra button mapping) and I am not saying port all your crappy titles to the PC just allow for full button mapping since games 10 years ago had them and new consoles and games are light years more advance in comparison… most of the time…and if you got balls that are not saggy and limp add in mouse and KB support most consoles know a days know what a mouse is it’s the software that refuses to use it….
