Zippy plus CRC (copy right circumvention) Well I have come to realize/find out (ah ignorance how blissful you are) that personal use is pretty much done since anything related to copy circumvention is illegal under the letter of the law. Despite that I would still say that under its combined sprit (CP, fair use and even the DMCA) it’s not so much about circumvention but personal use that its fair to circumvent protections for personal use. But even if it’s illegal now(for a few years actually) it’s basically un-enforced…and that’s makes me wonder if its un-enforced why is it even illegal when the real crime part of it is still a crime IE the distribution of the content.

Even if I believe that nonprofit based distribution should be legal to offset infinite CP and the power of the CP conglomerates one thing needs to be dealt with at a time. Personal use needs defined more than profit in copy right moving forward, personal use is where the line needs to be drawn in the sand and etched in stone. Personal use should be defined as anything done in the presence of the private end user in their limited to public private life.

Fair use is pretty much personal use but fair use pertains more in my laymen’s sense of things. Fair use is mostly about parody and how the conmen consumer can distribute CP/TM works via news or commentary which can allow for clips of various types (mix clips of a video with a song or a video of real non CP/TM people with CP/TM works in or around them). Limited as in as few people in public as possible mostly for portable media players and what not and not broadcasting/public performance or distribution online or off.

The minute a piece of media gets into the hands of the end user all rights of the CP owner end but distribution and invasive connections to the games online servers. This will allow for user made patches, fixes and end user protection against corporate over sight (IE all the stuff they miss focusing on limited anti consumer schemes) distribution will still remain the privy of CP owners lest until the system realize CP as it was meant to be is dead and fair use and public domain watch words for criminals. I still think the best thing moving forward is to give a corporate infinite copy right that specifies profit not distribution, allows for nonprofit non revenue gaining, meaning that costs of running the service with low paid or no paid labor at all levels of the organization compared against notional averages, if you are a private individual you can spend your money for distribution as long as you are not making a profit off it. This will allow nonprofit organizations to spread anything they deem educational or beneficial to society not to mention be able to run nonprofit based donational drives that can be used to buy up CP for the purpose of making it public domain. It will help corporate focus on real crime IE illicit profit and questionable organizations and get them out of the pants of the conmen end user and consumer.

It comes down to one sentence “If it’s not making profit it should be ignored.”
